These terms and conditions ("Terms") govern your use of the amplir.com website and the Amplir Launch platform operated by Amplir Ltd ("Amplir", "we", "us", "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. Definitions
- "Services" means the Amplir website, Amplir Launch platform, WhatsApp AI agent, website hosting, and any related features.
- "Customer" or "you" means any individual or entity that creates an account or uses our Services.
- "End User" means any person who interacts with a website or WhatsApp number created through our Services.
- "Content" means all text, images, data, and other materials you provide or generate through our Services.
2. Account registration
To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity under your account. Notify us immediately if you suspect unauthorised access.
3. Services
Amplir Launch
Amplir Launch allows you to create, customise, and publish a business website. Websites are built using AI-generated content based on information you provide. You retain ownership of the business information you supply. We retain the right to use the website templates, code, and platform infrastructure.
WhatsApp AI agent
The WhatsApp AI agent feature allows your business to receive and respond to customer messages via WhatsApp using an AI-powered assistant. By enabling this feature, you:
- Authorise us to register your phone number with the WhatsApp Business Cloud API via our Meta Business Account
- Acknowledge that customer messages will be processed by third-party AI services (Anthropic Claude) to generate responses
- Accept responsibility for ensuring your customers are aware that they may be communicating with an AI agent
- Agree to comply with Meta's WhatsApp Business Policy and Commerce Policy
- Understand that WhatsApp messaging is subject to Meta's terms, including their 24-hour messaging window policy
AI-generated content
Content generated by AI (website copy, WhatsApp responses) is provided on an "as is" basis. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and approving all content published on your website and ensuring the accuracy of information your AI agent provides to customers.
4. Subscriptions and payments
Paid features require an active subscription. Payments are processed by Stripe. By subscribing, you agree to:
- Pay all fees associated with your chosen plan at the stated intervals (monthly or annual)
- Automatic renewal of your subscription at the end of each billing period unless cancelled
- Provide valid and up-to-date payment information
You may cancel your subscription at any time through your dashboard. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
5. Acceptable use
You agree not to use our Services to:
- Violate any applicable law, regulation, or third-party rights
- Send spam, unsolicited messages, or bulk communications via WhatsApp or email
- Upload or distribute malicious code, viruses, or harmful content
- Impersonate any person or entity, or misrepresent your affiliation
- Engage in any activity that could damage, disable, or impair our Services
- Use the AI features to generate illegal, harmful, deceptive, or misleading content
- Attempt to access other users' accounts, data, or systems without authorisation
We reserve the right to suspend or terminate your account if you violate these terms.
6. Intellectual property
The Amplir platform, including its software, design, templates, and branding, is owned by Amplir Ltd and protected by intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to use our Services for the duration of your subscription.
You retain ownership of the business data and content you provide. By using our Services, you grant us a licence to use, process, and display your content as necessary to provide the Services.
7. Data protection
We process personal data in accordance with our Privacy Policy. By using our Services, you acknowledge that data may be processed by third-party providers including Supabase (authentication and database), Meta (WhatsApp), Anthropic (AI), Stripe (payments), and Resend (email).
If you use the WhatsApp AI agent, you act as a data controller for your customers' personal data. You are responsible for ensuring you have a lawful basis for processing their data and for providing appropriate privacy notices.
8. Availability and uptime
We aim to provide reliable access to our Services but do not guarantee 100% uptime. We may suspend access temporarily for maintenance, updates, or security reasons. We are not liable for any loss or damage caused by service interruptions.
9. Limitation of liability
To the maximum extent permitted by law, Amplir shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity, arising from your use of our Services.
Our total aggregate liability for any claim arising from or related to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Amplir, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our Services, your violation of these Terms, or your violation of any third-party rights.
11. Third-party services
Our Services integrate with third-party providers. Your use of these integrations is subject to the respective provider's terms:
- Meta (WhatsApp) — WhatsApp Business Terms of Service, WhatsApp Business Policy, Commerce Policy
- Stripe — Stripe Services Agreement
- Anthropic — Anthropic Usage Policy and Terms of Service
12. Termination
Either party may terminate these Terms at any time. You may cancel your account through the dashboard or by contacting us. We may terminate or suspend your access immediately if you breach these Terms.
Upon termination, your right to use the Services ceases immediately. We will retain your data for 30 days after termination to allow for data export, after which it will be deleted.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
